Terms Of Service

Introduction

These Terms of Service ("Terms") form a legally binding agreement between you and Junga LLC. ("Junga," "we," "us," or "our") and govern your access to and use of our websites, apps, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Use Of Service

Subject to these Terms, Junga grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes. You must provide accurate registration information, keep account credentials secure, and promptly update account information if it changes. You are responsible for all activity occurring under your account. Schools cannot register for Junga accounts at this time; educators may create individual keeper accounts and must use the Service in compliance with applicable law and institutional policies.

Security & Privacy

Your use of the Service is also governed by our Privacy Policy. We implement administrative, technical, and physical safeguards designed to protect information processed through the Service, including encryption controls and access restrictions. Backup data is encrypted at rest and retained for 7 days. Deleted user accounts and deleted child profiles are permanently removed after 24 hours. You acknowledge that no system can be guaranteed to be completely secure and you are responsible for maintaining the security of your own devices and credentials.

Junga Technology

The Service, including software, design, text, graphics, interfaces, and underlying technology, is owned by Junga or its licensors and protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, create derivative works, or use the Service to build a competing product or service. We may update, improve, suspend, or discontinue features at any time.

Online Safety

You may not use the Service to upload, post, transmit, or otherwise make available content that is unlawful, abusive, hateful, sexually explicit, exploitative, defamatory, fraudulent, invasive of privacy, or otherwise harmful. You may not use the Service to harass, impersonate, or endanger others, including children. We may investigate reports of misuse and may remove content, restrict features, suspend access, or terminate accounts where necessary to protect users, comply with law, or enforce these Terms.

Selfie With Junga Terms

Selfie With Junga is an optional feature made available through the Service. If you choose to use it, you instruct Junga to process the uploaded image, your generation instructions, and related data needed to create a composite output. You retain responsibility for the content you submit and for reviewing generated outputs before saving, sharing, or relying on them.

• You may only upload photos and submit instructions for which you have all necessary rights, permissions, and legally required consents, including consent from a parent or legal guardian where required.
• If an uploaded image contains a child or another person, you represent that you are authorized to submit that image for processing through the feature.
• Generated Selfie With Junga images may be saved to your account gallery and will remain available there until you delete them from your dashboard.
• You are responsible for reviewing generated images before sharing them and for not using the feature in a way that violates law, privacy rights, or these Terms.
• We may limit, suspend, or disable access to the feature, remove content, or decline processing where necessary to enforce these Terms, protect users, or comply with law.

Modification To The Agreement

We may modify these Terms from time to time. If we make material changes, we will provide notice by updating the "Updated" date and, where appropriate, by additional notice within the Service or by email. Unless otherwise required by law, changes become effective when posted. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms.

Acceptable Use And Conduct

You agree to use the Service lawfully and responsibly. You may not: (i) access or attempt to access non-public areas of the Service; (ii) interfere with, disrupt, or degrade Service performance; (iii) use automated means to scrape or extract data without permission; (iv) introduce malware or malicious code; (v) misuse child-related information; or (vi) violate any law, regulation, or third-party right. You are solely responsible for content and data you submit and for obtaining any rights, permissions, and consents necessary for that submission.

Warranty Disclaimer And Limitation Of Liability

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, and accuracy. to the maximum extent permitted by law, junga and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption, arising out of or relating to the service or these terms. to the maximum extent permitted by law, junga/'s total aggregate liability for all claims arising out of or relating to the service or these terms will not exceed the greater of: (a) the total amounts you paid to junga in the twelve (12) months before the event giving rise to liability, or (b) one hundred u.s. dollars (usd $100) if you have not paid any fees to junga. some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.',

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Junga and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Service; (ii) your content or data; (iii) your violation of these Terms; or (iv) your violation of applicable law or the rights of any third party.

User Interactions And Release

You are solely responsible for your interactions with other users and third parties through or in connection with the Service. Junga does not control and is not responsible for user conduct, third-party content, or third-party services. To the fullest extent permitted by law, you release Junga from claims, demands, and damages arising out of disputes between you and other users or third parties.

Copyright And Intellectual Property

Junga respects intellectual property rights and expects users to do the same. If you believe content on the Service infringes your copyright or other intellectual property rights, contact us with sufficient detail to investigate. We may remove allegedly infringing content and / or suspend repeat infringers in appropriate circumstances. Except for rights you grant us to operate the Service, you retain ownership of content you submit, and you represent that you have all rights necessary to provide that content.

Term And Termination

These Terms remain in effect while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, created risk or potential legal exposure, or where required by law. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, indemnity, and dispute terms, will survive.

Dispute Resolution

Please contact us first to attempt informal resolution of any dispute. Except where prohibited by law, these Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by binding individual arbitration administered by a nationally recognized arbitration provider, with the arbitration seated in Raleigh, North Carolina (Wake County). EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. This section does not prevent either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction in Raleigh, North Carolina, including for intellectual property infringement, unauthorized access, or misuse of data. If arbitration is held unenforceable for a particular claim, then the exclusive venue for that claim will be the state or federal courts located in Raleigh, North Carolina, and each party consents to personal jurisdiction there.

Service Provider Under The Ccpa

Where California law applies and Junga processes personal information on behalf of a business customer, Junga acts as a "service provider" (or "contractor," as applicable) and processes personal information only for the limited and specified purposes described in written agreements and applicable law. Junga does not sell personal information and does not share personal information for cross-context behavioral advertising. We implement reasonable safeguards and support lawful consumer rights request workflows as described in our Privacy Policy.

Miscellaneous

These Terms, together with any policies and additional terms expressly incorporated by reference, constitute the entire agreement between you and Junga regarding the Service and supersede prior or contemporaneous understandings on that subject. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Junga's failure to enforce any provision is not a waiver of its right to do so later. You may not assign or transfer these Terms without Junga's prior written consent; Junga may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure).

In the event of any conflict, inconsistency, or ambiguity between the English version of these Terms and any translated version, the English version will control. Section headings are for convenience only and do not affect interpretation.
